These Terms constitute a legally binding agreement between you and KHAOTIK.

You represent and warrant that:

• You are at least eighteen (18) years old, or
• You are accessing the Site under the supervision of a parent or legal guardian

You further agree that all information submitted to KHAOTIK is truthful, accurate, current, and complete.

KHAOTIK reserves the right, at its sole discretion and without prior notice, to:

• Refuse service
• Cancel orders
• Restrict or terminate access
• Limit purchases
• Remove or edit content
• Suspend operation of any portion of the Site

Use of the Site for unlawful, fraudulent, abusive, or unauthorized purposes is strictly prohibited.

You agree not to:

• Circumvent security features
• Interfere with Site functionality
• Deploy bots, scripts, crawlers, or automation systems
• Attempt unauthorized access to servers or systems
• Scrape or harvest Site data
• Misrepresent affiliation with KHAOTIK

Unauthorized use may result in civil liability and/or criminal prosecution.

All products are subject to availability and may be modified, discontinued, or removed at any time without notice.

KHAOTIK operates on a limited-release model. Products may include:

• Limited editions
• One-of-one garments
• Archive releases
• Vault exclusives
• Distressed or altered pieces
• Handmade or hand-finished products
• Preorder items
• Small-batch production runs

KHAOTIK makes no guarantee regarding future availability, reproduction, or restocking of any product.

Products displayed on the Site are not guaranteed to remain available until checkout is fully completed and payment is successfully processed.

Prices, product descriptions, imagery, availability, and promotional offers are subject to change without notice.

While KHAOTIK attempts to ensure accuracy, errors may occasionally occur, including but not limited to:

• Incorrect pricing
• Product description inaccuracies
• Inventory discrepancies
• Technical malfunctions
• Website display errors
• Misconfigured promotions or discount codes

KHAOTIK reserves the right to correct any errors and to refuse or cancel affected orders at any time, including after payment authorization has occurred.

If an order is canceled after payment has been captured, a refund shall be issued to the original payment method.

Submission of an order does not constitute acceptance of that order.

KHAOTIK reserves the unrestricted right to reject, limit, hold, or cancel any order for reasons including but not limited to:

• Suspected fraud
• Unauthorized resale activity
• High-risk transactions
• Chargeback history
• Billing inconsistencies
• Inventory issues
• Violation of these Terms
• Suspicious purchasing behavior

KHAOTIK further reserves the right to limit quantities purchased per customer, household, payment method, IP address, or shipping address.

All payments are processed through third-party payment processors.

By submitting payment information, you represent and warrant that:

• You are authorized to use the selected payment method
• Billing information provided is accurate
• You authorize the applicable charges

KHAOTIK does not directly store complete payment card information.

KHAOTIK shall not be liable for:

• Banking failures
• Payment processor outages
• Transaction delays
• Declined transactions
• Third-party payment errors
• Unauthorized access outside of KHAOTIK’s reasonable control

Shipping timelines are estimates only and are not guaranteed.

KHAOTIK shall not be liable for delays, losses, or damages arising from:

• Carrier delays
• Customs processing
• Weather conditions
• Delivery interruptions
• International import restrictions
• Labor disruptions
• Events beyond reasonable control

Risk of loss transfers to the customer upon transfer of possession to the shipping carrier where permitted by law.

Packages marked as delivered by the carrier shall be deemed fulfilled.

Customers are solely responsible for providing accurate shipping information at checkout.

KHAOTIK is not responsible for:

• Lost or stolen packages after carrier confirmation
• Incorrect addresses entered by customers
• Delivery access issues
• Unclaimed shipments

Certain products may be sold on a preorder basis.

By purchasing preorder items, you acknowledge and agree that:

• Production timelines are estimates only and are not guaranteed
• Manufacturing, sourcing, or fulfillment delays may occur
• Release schedules may change without prior notice
• Fulfillment windows are projections, not commitments
• Handmade details, specialty production methods, and small-batch manufacturing may result in extended fulfillment times

Customers may request cancellation and a full refund of a preorder only before production has officially begun. Once production has commenced, preorder purchases become non-cancelable and non-refundable except where otherwise required by applicable law.

KHAOTIK reserves the right, at its sole discretion and without liability, to adjust production schedules, release dates, fulfillment timelines, manufacturing processes, materials sourcing, and finishing techniques in connection with any preorder or special release.

By placing a preorder, customers acknowledge the artisanal and limited nature of KHAOTIK production and accept that extended lead times are an inherent feature of the brand's craft model.

Due to the limited and specialty nature of KHAOTIK products, all sales are considered final unless otherwise stated.

Returns, exchanges, or refunds may be refused for:

• Limited releases
• Archive/vault products
• Preorders
• One-of-one garments
• Worn merchandise
• Washed merchandise
• Distressed products
• Customized items
• Altered garments

Any approved return request must comply with all instructions provided by KHAOTIK.

Where a return is approved, KHAOTIK may, at its sole discretion, issue the refund as store credit in lieu of a refund to the original payment method, subject to the Return Policy and applicable law. Store credit is issued solely at KHAOTIK's discretion and remains governed by the terms of the Return Policy in effect at the time of issuance.

Original shipping charges are non-refundable. Unless otherwise required by applicable law, return shipping costs are the responsibility of the customer.

KHAOTIK reserves sole and final discretion regarding refund eligibility.

KHAOTIK gift cards are delivered digitally by email to the address provided at checkout. Gift cards are not preorder products and are made available for use upon successful delivery.

By purchasing or redeeming a KHAOTIK gift card, you acknowledge and agree that:

• Gift card purchases are final sale
• Gift cards are non-refundable and non-transferable except where prohibited by law
• Gift cards may not be redeemed for cash except where required by applicable law
• Lost, stolen, misplaced, or unauthorized use of gift cards may not be replaced or reimbursed
• Gift cards may not be reproduced, resold, or transferred without authorization

KHAOTIK reserves the right to refuse, cancel, suspend, or invalidate any gift card obtained through fraudulent, abusive, or unauthorized activity, including activity that violates these Terms or any applicable law.

Gift card terms may be supplemented by additional conditions disclosed at the time of purchase or redemption.

KHAOTIK may, from time to time, offer promotional pricing, discount codes, campaigns, or special offers. Such promotions may be modified, suspended, limited, or terminated at any time, in KHAOTIK's sole discretion and without prior notice.

Unless explicitly stated otherwise, discount codes and promotional offers may not be applied to:

• Preorder products
• Limited releases
• Archive products
• Vault exclusives
• Gift cards
• Special collections or collaborative releases

Promotional offers may not be combined, stacked, or used in conjunction with one another unless expressly permitted at the time of offer.

KHAOTIK reserves the right to cancel, void, or refuse to honor orders resulting from abuse, misuse, technical or pricing errors, unauthorized distribution of discount codes, or any other activity inconsistent with the intended use of a promotion.

KHAOTIK takes payment integrity seriously. Fraudulent chargebacks, unjustified payment disputes, or other abuse of payment systems may result in:

• Cancellation of pending or future orders
• Restriction or termination of account access
• Refusal of future service
• Recovery of associated fees and costs
• Legal enforcement where permitted by applicable law

KHAOTIK reserves the right to provide supporting documentation, including order records, communications, delivery confirmations, and account activity, to financial institutions, payment processors, and dispute-resolution bodies in connection with any payment dispute or chargeback inquiry.

Customers are encouraged to contact KHAOTIK directly to resolve order concerns prior to initiating a chargeback or payment dispute.

KHAOTIK products may intentionally feature:

• Distressing
• Wash treatments
• Dye variations
• Texture inconsistencies
• Fraying
• Hand-finishing
• Intentional imperfections

Such characteristics are considered part of the artistic and design process and shall not be deemed manufacturing defects.

Customers acknowledge that product appearance may vary due to:

• Screen calibration
• Lighting conditions
• Fabric treatments
• Photography editing
• Production variations

No two garments are guaranteed to be identical.

All KHAOTIK content and materials, including but not limited to:

• Logos
• Branding
• Product names
• Garment designs
• Graphics
• Artwork
• Typography
• Visual campaigns
• Layouts
• Photographs
• Videos
• Written content
• Website design elements

are the exclusive intellectual property of KHAOTIK and are protected under applicable intellectual property, trademark, copyright, and unfair competition laws.

Unauthorized reproduction, duplication, imitation, modification, distribution, manufacture, resale, republication, or commercial exploitation of any KHAOTIK product, design, logo, branding element, garment concept, visual identity, or creative asset is strictly prohibited.

This includes, but is not limited to:

• Replica garments
• Counterfeit reproductions
• Unauthorized remakes
• Reprinted graphics
• Copied product designs
• Use of KHAOTIK branding on third-party products
• Unauthorized commercial use of campaign imagery or creative assets

No resale, retail distribution, or wholesale authorization is granted without prior written permission from KHAOTIK.

KHAOTIK reserves all rights to pursue enforcement measures including, but not limited to:

• Platform takedown requests
• DMCA notices
• Marketplace reporting
• Account reporting
• Legal remedies where applicable

By submitting reviews, comments, tags, photographs, videos, or social media content featuring KHAOTIK, you grant KHAOTIK a non-exclusive, royalty-free, worldwide license to use, reproduce, publish, distribute, display, and repost such content for promotional and commercial purposes.

You represent and warrant that:

• You possess all necessary rights to submitted content
• Submitted content does not infringe third-party rights
• Submitted content is lawful and non-deceptive

KHAOTIK reserves the right to remove or refuse any submission at its sole discretion.

The Site may contain links to third-party platforms, services, applications, or websites.

KHAOTIK does not control and is not responsible for:

• Third-party content
• External policies
• Payment providers
• Shipping carriers
• Embedded tools
• Platform outages

KHAOTIK does not control or assume responsibility for the content, policies, security practices, or availability of third-party services, and users are encouraged to review the terms and privacy policies of any third-party platform before engaging with it.

THE SITE, PRODUCTS, SERVICES, CONTENT, AND MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KHAOTIK DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• ACCURACY

• CONTINUOUS AVAILABILITY

KHAOTIK DOES NOT WARRANT THAT:

• THE SITE WILL OPERATE WITHOUT INTERRUPTION
• DEFECTS WILL BE CORRECTED
• THE SITE WILL BE ERROR-FREE
• ACCESS WILL REMAIN UNINTERRUPTED OR SECURE

USE OF THE SITE IS AT YOUR SOLE RISK.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KHAOTIK SHALL NOT BE LIABLE FOR ANY:

• INDIRECT DAMAGES
• INCIDENTAL DAMAGES
• SPECIAL DAMAGES
• CONSEQUENTIAL DAMAGES
• EXEMPLARY DAMAGES
• PUNITIVE DAMAGES
• LOSS OF PROFITS
• LOSS OF BUSINESS
• LOSS OF DATA
• REPUTATIONAL HARM
• EMOTIONAL DISTRESS

ARISING FROM OR RELATED TO:

• USE OF THE SITE
• PRODUCTS PURCHASED
• DELAYED SHIPMENTS
• SITE INTERRUPTIONS
• TECHNICAL FAILURES
• THIRD-PARTY SERVICES

IN ALL CASES, KHAOTIK’S MAXIMUM AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.

You agree to defend, indemnify, and hold harmless KHAOTIK and its operators from and against any claims, liabilities, damages, losses, costs, expenses, or legal fees arising out of:

• Your breach of these Terms
• Your misuse of the Site
• Your violation of any law or third-party rights
• Fraudulent conduct associated with your account or activity

KHAOTIK does not guarantee uninterrupted access to the Site.

The Site may be modified, suspended, restricted, or temporarily unavailable due to:

• Maintenance
• Security incidents
• Platform outages
• Technical failures
• High traffic during product drops
• Operational updates

KHAOTIK shall not be liable for interruptions, downtime, or temporary inaccessibility.

Access to portions of the Site may occasionally be restricted during launches, vault releases, maintenance periods, or security events.

These Terms shall be governed by and construed under the laws of the State of California, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms or use of the Site shall be resolved in a court of competent jurisdiction located within California, unless otherwise required by applicable law.

KHAOTIK reserves the right to revise, update, or modify these Terms at any time without prior notice.

Updated Terms become effective immediately upon posting to the Site.

Continued use of the Site following any modifications constitutes acceptance of the revised Terms.

If any provision of these Terms is determined to be unlawful, void, or unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.

Failure by KHAOTIK to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

These Terms, together with any policies or notices posted on the Site, constitute the entire agreement between you and KHAOTIK regarding use of the Site and supersede prior communications or agreements relating thereto.

Customers may participate in the KHAOS POINTS rewards program subject to these Terms and any program-specific rules posted on the Site.

• Customers earn 1 KHAOS POINT for every $1 spent.
• Gift card purchases do not earn KHAOS POINTS.
• Points are non-transferable.
• Points have no cash value.
• KHAOTIK reserves the right to modify, suspend, or terminate the rewards program at any time.
• Returns, refunds, cancellations, or chargebacks may result in point deductions.
• Abuse, fraud, or manipulation of the rewards system may result in forfeiture of rewards and account restrictions.

KHAOTIK may, at its sole discretion, adjust point balances, redemption thresholds, eligibility criteria, or expiration rules to maintain the integrity of the program.

The KHAOS POINTS referral program allows customers to invite others to KHAOTIK using a unique personal referral code.

• Every customer account receives a unique referral code.
• Referred customers receive 500 KHAOS POINTS after their first qualifying purchase.
• Referring customers receive a $20 reward after the referred customer completes their first qualifying purchase.
• Self-referrals are prohibited.
• Duplicate accounts created to obtain rewards are prohibited.
• KHAOTIK reserves the right to revoke referral rewards obtained through abuse, fraud, or manipulation.

A qualifying purchase means a successfully paid order that has not been cancelled, refunded, or charged back. Referral rewards are issued only after the qualifying purchase is finalized.
